The state policy of the Republic of Belarus in the field of culture is aimed at preserving the uniqueness of the culture of the Belarusian people and national traditions, the revival, preservation and development of cultural heritage, ensuring the accessibility of cultural values for the whole population, and integrating into the system of world culture as an equal participant.
The protection of the historical and cultural heritage is a whole system of organizational, legal and economic measures.
The main document in this area is the Law of the Republic of Belarus "On the Protection of Historical and Cultural Heritage of the Republic of Belarus" of January 9, 2006 No. 98-3 (hereinafter - the Law).
Historical and cultural values are material objects and intangible manifestations of human creativity that have distinctive spiritual, artistic and (or) documentary merits and are given the status of historical and cultural value (Article 1 of the Law).
Upon receipt of reasonable proposals to the Ministry of Culture on giving the object the status of historical and cultural value, the materials presented are considered at a meeting of the Belarusian Republican Scientific and Methodological Council on the Issues of Historical and Cultural Heritage of the Ministry of Culture of the Republic of Belarus.
The Council of Ministers of the Republic of Belarus makes a decision to impart to the objects the status of historical and cultural values, according to which the scientific and methodical council has given a positive conclusion.
The Ministry of Culture maintains the State List of Historical and Cultural Values of the Republic of Belarus in accordance with the procedure established by the Council of Ministers of the Republic of Belarus.
Currently, the State List of Historical and Cultural Values of the Republic of Belarus includes objects whose status is approved by the Decrees of the Council of Ministers of the Republic of Belarus No. 578 of May 14, 2007, No. 1288 of September 3, 2008, No. 1088 of August 19, 2009.
The state list is registered in the State Register of Information Resources (Decree of the Ministry of Culture of the Republic of Belarus No. 1129 of July 29, 2010).
Accounting documents for historical and cultural values (Article 25 of the Law).
For each historical and cultural value, a registration card is filled in and a uniform passport is drawn up (Decree of the Ministry of Culture of the Republic of Belarus of December 8, 2006 No. 40). Drawing up of registration documents is carried out by the project organization at the expense of the owner of the historical and cultural value (Part 7, Article 25 of the Law).
On an immovable material historical and cultural value a protective board of an approved sample is installed at the expense of the owner of the historical and cultural value (Part 5, Article 28 of the Law).
To ensure the preservation of immovable material historical and cultural value, they develop a draft of protection zones.
The modes of content and use of objects, established in the projects of protection zones, provide measures to prevent negative impact on historical and cultural value, because they are obligatory for execution by all legal and physical persons without exception (article 29 of the Law).
